1. Agreement to Terms

By accessing or using ScapeGrowth's services (“Services”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access the Services.

2. Description of Services

ScapeGrowth provides AI-powered voice agent services, including but not limited to automated phone answering, lead qualification, appointment scheduling, call routing, and related communication services.

3. Account Registration

To use certain features of our Services, you must register for an account. When you register, you agree to provide accurate, current, and complete information; maintain the security of your password; and notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to use the Services to violate any applicable laws, infringe on the rights of others, send spam, transmit malicious code, impersonate any person or entity, or use the Services for any illegal or unauthorized purpose.

5. Payment Terms

Certain Services require payment. You agree to pay all fees associated with your subscription plan. Fees are billed in advance on a monthly or annual basis and are non-refundable except as expressly stated in our Refund Policy.

6. Call Recording and Data

Our Services may record and transcribe phone calls for quality assurance, training, and service improvement. You are responsible for ensuring compliance with all applicable call recording laws in your jurisdiction.

7. Intellectual Property

The Services and their original content, features, and functionality are owned by ScapeGrowth and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Service Availability

We strive to maintain 99.9% uptime for our Services. However, we do not guarantee uninterrupted access and may suspend Services for maintenance, updates, or circumstances beyond our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCAPEGROWTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Governing Law

These Terms shall be governed by the laws of the State of Washington, United States. Any disputes shall be resolved in the state or federal courts located in Clark County, Washington.
